Estate Planning & Trust Administration

Our founder, Lynn Aust Moot has created more than 2,500 estate plans for her clients since 2002. Estate plans could include simple Wills, Durable Power of Attorney, Healthcare Surrogate Designation, Living Will and HIPAA Authorizations. For more extensive planning, we offer Special Needs planning, Revocable and Irrevocable Trusts and Lady Bird Deeds.

After  the creator of a Trust dies, legal guidance from an experienced Trust attorney can ensure that the Trust is properly administered and provides much needed guidance to their family and the successor Trustee.  We can greatly simplify the process.



Guardianships

With proper planning, many guardianships can be avoided. However, Guardianship may be needed due to age, diminished capacity, lack of capacity , accident or illness. If it is needed, we have 20+ years of experience helping clients establish and maintain, Guardian of the Person, Guardian of the Property and Guardian Advocate for temporary and permanent needs, as well as in representing the incapacitated person.

 

 



Probate

When a loved one dies owning assets exclusively in their name or their estate, the court process known as PROBATE will be required to ensure the assets get transferred from the loved one to their beneficiary named in their Will or Trust. If they died without a Will or Trust, then the State of Florida determines who inherits the assets.

There are three types of Probate under Florida law so please contact Lynn Aust Moot to determine what you need. The initial 30 minute consultation is complimentary.

 

 



Business Planning

Our firm can help you establish your new business ensuring it is set up properly so as to maximize your liability protection on your personal assets.

 If you have an established business, we can drafts and/or review commercial leases, contracts, agreements and education on proper formalities for liability protection. 

If you are looking to buy or sell a business, we have literally handled hundreds of business sales  and stand ready to help for a smooth transfer.

 

 



Special Needs

Special Needs Trusts and Supplemental Needs Trusts are created to preserve the eligibility for government benefits of a person with special needs.  Protecting government benefits such as Medicaid are crucial for a person with special needs, if not now then later in life. We can help ensure your loved one with special needs is protected and their inheritance is secure.

 

 



Medicaid Planning

Qualifying for Medicaid is a two prong test of  measuring the applicant's income and assets. To save clients on legal fees, we use a non-attorney company to file the Medicaid application but we prepare any legal documents to help the applicant meet the two prong test.
